Known as "Lessee"
You (defined as customer/lessee to this Agreement)

Collectively, all of the above people or businesses entering this Agreement will be referred to as the "Parties." This Equipment Rental Agreement ("Agreement") is made effective by purchasing services via Lessor's website. By completing an online purchase, Lessee agrees to be bound by these terms and conditions.

Purpose

They Were There is a camera rental and editing service offered by Love Story By Aira Photography. Rather than professional camera operators, a compact camera is placed in the hands of Lessee's family and friends, capturing candid, behind-the-scenes moments throughout the wedding day. This service is not a replacement for professional wedding videography.

Services & Equipment

Lessor will provide Lessee with one of the following packages, as selected at the time of purchase:

Option A — One Camera: $780
One DJI Pocket 3 camera, one tripod, one 256GB SD card, one battery, one protective case, one MicroSD card reader, and one carrying case.

Option B — Two Cameras: $1,080
Two DJI Pocket 3 cameras, two tripods, two 256GB SD cards, two batteries, two protective cases, one MicroSD card reader, and two carrying cases.

Rental Period. The Equipment will be shipped to Lessee 3–4 days prior to the wedding date. The rental period expires within 72 hours of the end of the wedding day. Lessee must return-ship the Equipment to Lessor before the shipping cut-off time on the last day of the Rental Period using the prepaid shipping label provided by Lessor.

Shipping. Lessor will cover the cost of both outbound and return shipping. Lessee must use the prepaid return shipping label provided by Lessor. Lessee agrees to obtain and retain the shipping receipt for all return shipping until Lessor notifies Lessee of receipt of the returned Equipment. Lessor cannot guarantee the arrival date of the Equipment as delivery timelines are outside Lessor's control.

Backup Recommendation. Prior to returning the Equipment, Lessee is strongly encouraged to back up all footage to a personal computer or cloud storage. Lessor is not responsible for any loss of footage occurring after the Equipment has been returned.

Setup & Instructions

Lessor will provide setup instructions via tutorial video and written instruction card included in the shipment. No prior filming experience is required. Lessor is not responsible for the content, quality, or quantity of footage captured by Lessee's family members or guests.

Delivery of Edited Films

Lessor will deliver the following to Lessee via Google Drive:

Raw footage: within 2 weeks of Lessor's receipt of the returned Equipment
Edited highlight film: within 8–10 weeks of Lessor's receipt of the returned Equipment

Delivered films:
— Option A: one 3–5 minute highlight film + all raw footage
— Option B: one 5–7 minute highlight film + all raw footage

Raw footage will remain accessible for 3 months from the date of delivery. The edited highlight film will remain accessible for 6 months from the date of delivery. Lessee is encouraged to download all files promptly upon receipt and back up all footage to a personal computer or cloud storage.

Revisions. This service includes one round of revisions to the edited film. Revision requests must be submitted in writing within 14 days of delivery. Additional revision rounds are available at $250 per round.

Payment

Payment is made in full at the time of online order placement via Lessor's website. All sales are final unless otherwise stated in the Refunds & Cancellation section of this Agreement.

Representations, Warranties & Agreements

Lessor represents and warrants that: (1) the Equipment is free from known defects and is in good working order at the time of shipment; (2) Lessor is responsible for routine maintenance of the Equipment prior to rental; (3) Lessor has the right to enter into this Agreement.

Lessee agrees that: (a) the Equipment is rented without any warranty of merchantability or fitness for a particular purpose beyond what is stated above; (b) Lessor shall not be held responsible for production downtime, loss of profits, indirect, consequential, or punitive damages; (c) Lessee assumes full responsibility for the Equipment from the time of delivery until the Equipment is received back by Lessor.

Normal Wear and Tear. Lessor covers normal wear and tear, including minor surface scratches, light exterior scuffing, and minor button fading from regular use.

Damage & Loss. For anything beyond normal wear and tear — including but not limited to cracked screens, water damage, drop damage, lens damage, or loss of any item — Lessee shall be responsible for the actual cost of repair or replacement, whichever is lower, up to a maximum of $500 per item or $1,000 per package. Lessor reserves the right to invoice Lessee for any such costs.

Refunds & Cancellation

Video Guarantee. Lessee is eligible for a full refund under the following circumstances:

1. The Equipment leased by Lessor is determined to be the cause of malfunction, preventing Lessee from recording any footage, as determined by Lessor upon inspection of the returned Equipment.
2. Lessee is unable to record any video during the wedding day despite following all setup instructions properly and the Equipment was in working condition, as determined by Lessor upon inspection of the returned Equipment.
3. The Equipment package is lost in outbound shipping and Lessee does not receive the Equipment.

The following situations disqualify Lessee from eligibility under the Video Guarantee:

1. Failure to return Equipment to Lessor.
2. Cancellation of order by Lessee.
3. Failure to complete setup procedures supplied by Lessor.
4. User error or damage to Equipment, including failure to power on the Equipment, failure to properly charge batteries, or failure to use provided memory cards.
5. External factors beyond Lessor's control, including environmental damage or electrical interference.

Cancellation Policy.
— 30+ days before the wedding date: full refund
— 15–30 days before the wedding date: 50% refund of the total amount paid
— Within 15 days of the wedding date: no refund

Rescheduling Policy.
— 15+ days before the wedding date: one free reschedule
— Within 15 days, before the Equipment has shipped: 20% of the total order amount as a rescheduling fee
— After the Equipment has shipped: the rental period has begun and rescheduling is no longer available

Intellectual Property & Copyright

Lessor owns all copyrights in any and all work produced pursuant to this Agreement, whether registered or unregistered, in accordance with federal copyright law (Title 17, Chapter 2, Section 201-02 of the United States Code).

Lessor grants Lessee a non-exclusive, perpetual license to use, share, download, and store all delivered footage and edited films for personal purposes, including sharing on personal social media pages and profiles.

Lessee grants Lessor a non-exclusive license to use the edited films for portfolio, website, and promotional purposes, including social media.

Limit of Liability

Lessee agrees that the maximum amount of damages Lessee is entitled to in any claim relating to this Agreement shall not exceed the total amount paid by Lessee to Lessor under this Agreement.

Lessee shall indemnify Lessor against, and hold Lessor harmless from, any and all claims, actions, costs, expenses, damages and liabilities arising out of or resulting from Lessee's use, possession, or return of the Equipment.

Non-Working Equipment

Lessee shall notify Lessor immediately upon receipt of Equipment of any malfunction or damage. Lessee must not attempt to repair or modify the Equipment. In the event of non-working Equipment that is not the result of Lessee's negligence, Lessor will either replace the Equipment or issue a full refund of rental charges at Lessee's option.

Artistic Release

Lessee has reviewed Lessor's portfolio and has a reasonable expectation that Lessor will perform editing services in a similar manner and style. Lessee understands that editing is a subjective art and Lessor shall have final say regarding aesthetic and artistic judgment. Dissatisfaction with Lessor's editing style or artistic judgment is not a valid reason for termination of this Agreement or request for a refund.

Force Majeure

Lessor will not be liable to Lessee for failure to perform any obligations herein in the event of strikes, lockouts, acts of God, fire, flood, pandemic, or other events outside Lessor's reasonable control.

General Provisions

Entire Agreement. This Agreement contains the entire understanding between the Parties and supersedes all prior agreements, negotiations, or discussions between the Parties.

Severability. If any portion of this Agreement is deemed illegal or unenforceable, the remaining provisions shall remain in full force.

Amendment. This Agreement may only be amended by written consent of both Parties.

Notice. All notices shall be provided via email.

Governing Law. This Agreement shall be governed by the laws of the State of Maryland. Any legal proceedings shall be subject to jurisdiction and venue in the State of Maryland.
